Framework of processing

We collect personal data from key contacts of clients, prospective clients and suppliers; this data is collected by the controller (WDS) by use of trade fairs within the scope of contract performance or pre-contractual measures, or by foreign surveys executed by legally independent sales representatives. In addition, personal data is obtained from specialist journals.

Personal data is stored for the duration and for the purpose of performance of a contract or pre-contractual measures (article 6-paragraph 1 lit. b) and is deleted as per erasure concept in accordance with the legal requirements. Personal data of key contacts are stored beyond contract fulfillment for support purposes. For this purpose, a legitimate interest exists according to Art. 6 para. 1 lit. f. However, erasure takes place at the latest with the expiration of the statutory period of limitation according to § 195 German Civil Code (BGB).

The storage of personal data is essential for the performance of contractual or pre-contractual measures and for the provision of support services. Non-provision of personal data may result in delayed performance of the contract. Likewise, certain support services can no longer be provided in full. Automated decision-making including profiling according to Art. 22 para. 1 and 4 GDPR does not take place.

Transfer and foreign relation

In addition to public agencies that receive personal data in accordance with legal obligations, personal data of clients and prospective clients is passed on to commercial agents. No transfer of personal data is made to a recipient in a third country nor is it the controllers intention to do so.

Moreover, a right to object processing as well as the right to data portability exists. Existing consents to data processing of Data Subjects according to Art. 6 Para. 1lit. a, or Art. 9 para. 2lit. a, are withdrawable at any time, without affecting the lawfulness of processing based on consent before its withdrawal. Data Subjects also have the right to lodge complaints with a supervisory authority.
